Prenuptial Agreement

A prenuptial agreement, often referred to as a prenup, is a legal contract entered into by a couple
before they get married. No one enters into a marriage expecting to divorce. When we say, “I
do,” it is with the expectation that is forever. Unfortunately, that is not the reality for many
couples. When Tanya represented people in contested divorce and custody cases, she watched
couples that once vowed “’til death do us part” spend in excess of $20,000 and $50,000 to tear
apart their spouse and make their lives a nightmare. This did not make good financial sense, nor
were they able to begin the process of healing and moving on.

A prenuptial agreement can eliminate most of the ugliness of a divorce through planning, while
still totally in love, how the financial assets will be divided in the event of a divorce. A
prenuptial cannot address issues of child custody or support, but can determine how to treat and
divide retirement, bank accounts, inheritance, investments, businesses, houses, and debts, and
whether there will be alimony.
While a prenuptial may not be necessary or appropriate for every couple, there are several
reasons why individuals consider getting one:

  1. Asset protection.
  2. Clarifying financial expectations.
  3. Avoiding lengthy and costly legal battles.
  4. Protecting one party from the other’s debts.
  5. Establishing spousal support.
  6. Protecting family interests.

If you are planning your wedding, make part of that plan to speak with Tanya about whether a
prenuptial agreement is right for you.

Mediation

Save money, time, and energy by mediating legal matters such as divorces, and probate and
estate disputes. Litigation is expensive and taxing on emotions and energy. Litigation can also
bring out the worst in people. Mediation can save parties thousands of dollars and bring an
amicable and quick end to the stress and strain of litigation.

Mediation is a process where the parties to a dispute select an impartial and neutral person to
assist them to reach a mutually agreed upon resolution to their dispute. Generally, this happens
during the course of litigation, but can certainly take place prior to the filing of a lawsuit.

Tanya is a registered mediator in Alabama for divorce, and all other civil matters, including
probate and estate disputes. She can mediate disputes for people who are not represented by

lawyers as well as those who are represented. Tanya’s extensive litigation experience gives her
unique perspective in helping people reach a resolution to their legal disputes.
